What I would tell you legally (in addition to the advise noted by /u/domesticpig) is that you should complain to your employer. WE oversee over 150k accounts and have never heard of any customer being audited. So I would put the risk at insignificant. It wouldn't be good legal advise to tell you that the IRS rarely audits these things and your chances of getting caught or slim to none. So, what's the risk of submitting a modified receipt? ![]() I don't believe that I'm defrauding anyone here I'm 100% certain that I'm legally entitled to my own pre-tax money for daycare. It doesn't take photoshop master to change the text on a digital receipt. I am sorely tempted to change the receipt myself, and I don't know if I'm taking a stupid legal risk. I have a very limited time (about 2 weeks) to get my October receipts in, and there's a holiday week in there. The basic response that I've gotten is that it's a corporate receipt template (it's a franchise), and, while I trust these people with my son's care, they do not have great software skills. They've been very slow to respond, because the owner is the primary person handling the billing. I went back to the daycare to get the receipts changed (and get past receipts re-issued). I guess they really need to see the words "day care" directly in the line item (even though the business description is "child care" on the header) The line item on the receipts is "tuition," and they decided that isn't an adequate description. Apparently, they decided to get stricter on the rules. This worked fine for 2 years, but just recently, the HR company started rejecting my receipts (and thus cutting off my reimbursements). Annoying process, but it saves me a good amount of money. Money gets taken out of my paycheck pre-tax, and I submit receipts from the daycare to a 3rd party HR company to get my money reimbursed. I've been using a Dependent Care Account (via my employer) to help pay for my son's daycare. This is bureaucratic tax bullshit, not landlocked property drama. Sorry if this is too boring for you guys.
